Ripple v. SEC: The case that refuses to die

Image
XRP is regaining momentum as institutional adoption grows backed by a solid technical outlook and growing speculation about potential spot exchange-traded funds (ETFs). However, the market is now mostly focused on the ongoing legal battle between Ripple and the U.S. Securities and Exchange Commission (SEC).  First filed in December 2020, the case is heading toward another pivotal moment as it approaches the August 15 deadline by which the SEC is required to update the appellate court on the status of the dispute. Ripple vs. SEC August 15 deadline: What does it mean? The kernel of the problem is the question of whether Ripple’s XRP sales constituted unregistered securities offerings.  A 2023 ruling by the U.S. District Judge Analisa Torres already found that institutional sales did qualify as securities, while programmatic sales on various exchanges did not. Though Ripple recently withdrew its appeal, the SEC has yet to follow suit.  Judge ...

The three most likely outcomes for SEC v. Ripple lawsuit

From the day the Jay Clayton-chaired Securities and Exchange Commission (SEC) filed its lawsuit against Ripple in December 2020, the final outcome has been up for debate. According to one side, commissioners would obviously prevail on the merits of SEC v. Ripple et al. In contrast, investors who appreciated the thousands of percentage point gains in XRP’s price since its Initial Coin Offering (ICO), found it hard to sympathize with the SEC’s attempt to protect investors from non-existent harm.  The lawsuit was born into controversy. Clayton resigned as chairman one day after commissioners jointly filed their SEC lawsuit, suspiciously stepping down from his term six months early. Without explaining itself, the SEC also dropped its personal charges against Ripple co-founders Chris Larsen and Brad Garlinghouse.  As litigation dragged on, certainty about any particular outcome faded. Ripple’s well-paid lawyers guided the suit through proceedings for years with no final decisi...

SEC’s Latest Filing Does Not Appeal Court’s XRP Security Status Ruling, Says Ripple Legal Chief

Image
Ripple chief legal officer Stuart Alderoty says the recent filing by the US Securities and Exchange Commission (SEC) in its case against Ripple Labs does not appeal the ruling that XRP is not a security. Alderoty’s comments follow an Oct. 16 Form C filing by the SEC with a pre-judgement statement against certain aspects of the court’s summary judgment.  Alderoty Says Court Decision Regarding XRP’s Security Status “Stands As The Law Of The Land” Ripple defense attorney James Filan shared the filing on Oct. 17. In their appeal, the SEC asks the court to review its decisions related to Ripple’s XRP sales through exchange platforms. It also requests the court to review the ruling on the personal sales executed by Ripple executives Brad Garlinghouse and Chris Larsen . Judge Approves Ripple Request To Stay $125 Million SEC Penalty, Company Signals No Appeal Plans

Image
A New York District Judge approved a request by Ripple Labs to pause the $125 million penalty imposed in the company’s ongoing lawsuit with the US Securities and Exchange Commission (SEC). The order, signed by Judge Analisa Torres of the Southern District of New York, grants both Ripple and the SEC additional time to appeal the recent ruling. Despite the pause, Ripple executives, including CEO Brad Garlinghouse, have indicated they have no plans to appeal the decision. Garlinghouse hailed the ruling as a “victory for Ripple,” while the company’s legal officer, Stuart Alderoty, confirmed that Ripple would “respect the $125 million fine.” The stay in the Ripple SEC case will last for 30 days after the time the appeal expires or the resolution of any appeal in the case.  The SEC asked for $2B, and the Court reduced their demand by ~94% recognizing that they had overplayed their hand. We respect the Court’s decision and have clarity to co...

A closely followed trader is offering his two cents on why he thinks memecoins have exploded in popularity among crypto traders. Pseudonymous analyst Jack Sparrow tells his 251,000 followers on the social media platform X that traders are not sinking capital on memecoins because they believe in their fundamentals or whether meme communities will serve as the cornerstone of the future of finance. The trader says memecoins offer something that most crypto assets don’t: a degree of freedom from the hostile hands of the U.S. Securities and Exchange Commission (SEC). “Memecoins are one of the final frontiers that are somewhat in an unregulated untouchable position. Lack of regulation and the degenerates will gamble in PVP (person vs. person) style games and it being one of the few places left possible without restrictions.” According to the analyst, the exact same scenario has played out before such as the launch of decentralized finance (DeFi) and n...
